Manufacture of non-environmentally acceptable packaging materials "I am a factory worker in a manufacturing company. My supervisor has informed me that some of our products are not environmentally acceptable packaging materials but that I have to be silent about these. What law does my employer violate?Wesminton Dear Wesminton,For your information, the law that addresses your situation is Section 48 (12) of Republic Act 9003, otherwise known as the “Ecological and Solid Waste Management Act of 2000,” which reads: “Section 48. Prohibited Acts - The following acts are prohibited:“xxx “(10) The manufacture, distribution or use of non-environmentally acceptable packaging materials”Relatedly, the same law provides a penalty for violation of the same, viz: “Section 49. Fines and Penalties –“(e) Any person who violates Sec. 48, pars. (12) and (13) shall, upon conviction, be punished with a fine not less than Ten thousand pesos (P10,000.00) but not more than Two hundred thousand pesos (P200,000.00) or imprisonment of not less than thirty (30) days but not more than three (3) years, or both”It is clear from the cited provisions that the manufacture, distribution or use of non-environmentally acceptable packaging materials are illegal and may subject the offender to a penalty of fine or imprisonment, depending upon the discretion of the Court.
