ON-THE-JOB TRAINING AGREEMENT
This ON-THE-JOB TRAINING AGREEMENT made and executed this 7th day of June 2013, Cebu City, Philippines by and between:
Metropolitan Cebu Water District, a government-owned-and-controlled-corporation, with original charter (P.D. 198), with principal office at Corner Lapu-Lapu and Magallanes Sts., Cebu City, Philippines, hereinafter referred to as the Water District
- and -
Juan dela Cruz, of legal age, Filipino, resident of Duljo, Fatima, Cebu City, hereinafter referred to as the "ON-THE-JOB TRAINEE".
WITNESSETH
The parties agree to be bound by the terms and conditions stipulated hereunder;
- That the ON-THE-JOB TRAINEE is not entitled to any compensation or honorarium from the Water District since his/her training is solely for the purpose of undergoing a practical job training as part of the school curriculum or as requisite for graduation or board examination;
- That there shall be no employer-employee relationship established between the Water District and the ON-THE-JOB TRAINEE;
- That the ON-THE-JOB TRAINEE shall not be allowed to render overtime work nor can he/she be compelled to render the same by the Water District;
- That the ON-THE-JOB TRAINEE shall not be allowed to perform tasks which will involve high physical risks nor shall he/she be allowed to perform assignments outside the MCWD main office;
- That the term of the Agreement shall start on JUNE 16, 2013 (Schedule: MWF: 1-3pm / TTh: 8am - 5pm) until a minimum service period of 100 training hours is accomplished;
- That the WATER DISTRICT binds itself to train the ON-THE-JOB TRAINEE under the HUMAN RESOURCES DEPARTMENT and the ON-THE-JOB TRAINEE in turn accepts the terms of the training;
- That the ON-THE-JOB TRAINEE shall strictly observe the WATER DISTRICT'S policies, company rules and regulations, or memoranda regarding and/or governing its employees
- That in case of untoward incidents to the ON-THE-JOB TRAINEE, MCWD will not be liable therefor, and
- That the WATER DISTRICT reserves the right to terminate this agreement even before the expiration of period of the training on grounds of violation of the Water District's rules and regulations and such other just and other valid causes provided for by law.
IN WITNESS WHEREOF, the parties hereto have hereunto affixed their signatures this 16th day of JUNE 2013 at Cebu City, Philippines.
