ERC subjects proposed revisions to the RDWR to public feedback

The Energy Regulatory Commission (ERC) posted on its website (www.erc.gov.ph) on 22 September 2011 the proposed revisions to the Rules for Setting the Distribution Wheeling Rates (RDWR) for the Second Entry Group privately-owned distribution utilities operating under the Performance Based Regulation (PBR) for its Third Regulatory Period of April 2013 to March 2017.  The Second Entry Group or Group B is composed of Cotabato Light and Power Co. (CLPC), Iligan Light and Power, Inc. (ILPI), and Mactan Electric Company (MECO).  The updated RDWR is needed to prepare the Regulatory Reset Issues Paper.
"There is a need to update the current version of the RDWR to incorporate significant changes and make it appropriate for the Second Entry Group which are entering the Third Regulatory Period commencing on April 2013,” ERC Chairperson Zenaida G. Cruz-Ducut stated.

The highlights of the proposed changes to the existing RDWR include the following:  (1) only coordinated schedules and dates pertaining to the Second Entry Group are presented; (2) definitions for new terms and update some terms in the current RDWR; (3) a provision on the treatment of revenue earned and historical performance levels achieved for the Second Regulatory Period as inputs in computing the Maximum Average Price (MAP) for the Third Regulatory Period; and (4) new rate-setting provisions to be applied during the Third Regulatory Period.

Comments on the proposed revisions to the RDWR from the electric power industry stakeholders, including the consumers, will be entertained by the ERC up to 12 October 2011 (Wednesday).  Thereafter, Public Consultations (PubCons) are scheduled on the following dates and venues:  (1) 21 October 2011 (Friday) at 2:00 PM in Iligan City;   (2) 27 October 2011 (Thursday) at 2:00 PM in Lapu-lapu City; and (3) 03 November 2011 at 2:00 PM in Cotabato City.

The RDWR is an evolving document that was promulgated by the ERC in July 2006.  Section 1.9 thereof states that amendments on the RDWR may be done from time to time to better reflect the actual situation currently faced by regulated entities for the rate-setting process and also reduce undue risks on the consumers.  Also, Section 7.1.2 of the RDWR [Second Entry Group: Third Regulatory Period] states that the ERC is required to prepare and publish the Regulatory Reset Issues Paper which aims to provide the ERC’s initial views on the issues raised by the pending Regulatory Reset process for the Second Entry Group.
