Inability to deliver an entrusted package
"I am an overseas Filipino worker currently employed in Dubai. Last year, I requested my Filipino co-worker to deliver a pasalubong to my family in the Philippines. But the items that I sent were not delivered and my co-worker has avoided communication with me. I just want to know if he can be sanctioned by the Philippine Overseas Employment Administration (POEA) in order to prevent him from further working abroad.

Embezzling any money and/or property entrusted by a fellow Filipino worker for delivery to his/her kin or relative in the Philippines is classified as a less serious offense under Section 145 (B)(g), Rule V, Part VI, Revised POEA Rules and Regulations Governing the Recruitment and Placement of Land Based Overseas Filipino Workers of 2016:“g. Embezzlement of company funds or monies and/or properties of a fellow worker entrusted for delivery to kin or relatives in the Philippines.
“Penalty:“1st Offense — Suspension from participation in the overseas employment program (two months to six months)
“2nd Offense — Suspension from participation in the overseas employment program (six months and one day to one year)“3rd Offense — Permanent disqualification from participation in the overseas employment program.”In your situation, your Filipino co-worker is liable pursuant to the above-mentioned rules, and may be suspended and/or permanently disqualified (after the third offense) by the POEA from participating in the overseas employment program.We hope that we were able to answer your queries.
