"My family rented a house and lot. The owner and I executed a lease contract for one year and we have been renting the house for three months now. The owner of the house, however, sold the property to another person. Presently, the buyer of the house is trying to eject us from the property. I just want to know if the buyer can validly do this. AriesDear Aries, A new owner of a leased premises is prohibited from ejecting the tenant therein during the existence of the lease. This is clear from Section 10 of Republic Act 9653 or the “Rent Control Act of 2009”, viz:“Section 10. Prohibition Against Ejectment by Reason of Sale or Mortgage. - No lessor or his successor-in-interest shall be entitled to eject the lessee upon the ground that the leased premises have been sold or mortgaged to a third person regardless of whether the lease or mortgage is registered or not.” You stated that you entered into a lease contract for one year with the previous owner of the property and has been only living therein for three months. Hence, you still have nine months left in your lease contract.
