In order to ensure the highest quality service for subscribers, SKYBROADBAND enforces this Appropriate Use Policy (AUP). This AUP serves to guide subscribers on:
(1)How to use the service appropriately, and
(2)What to do in case a customer encounters a violation of this AUP.
The provisions of this AUP are as follows:
1. SKYBROADBAND has the right to change the provisions in this AUP without prior notice.
2. Subscribers agree to the provisions of this AUP each time they use SKYBROADBAND.
3. SKYBROADBAND supports the freedom to express ideas and share information over the Internet. SKYBROADBAND does not monitor nor edit contents of web pages, electronic messages, mailing lists, newsgroups or any other material accessible through SKYBROADBAND's service. However, SKYBROADBAND may, at its sole discretion, deny access to, or perform any other necessary action on materials that are illegal, may expose SKYBROADBAND to liability, or violate any of the provisions in this AUP. Examples of illegal activities are:
- Unauthorized use of copyrighted material including, but not limited to, digitization and distribution of photographs, written materials, music, videos, etc. from copyrighted sources.
- Unauthorized use and distribution of copyrighted software.
- Exporting software or technical information in violation of export control laws.
- Posting or e-mailing of scams such as 'make-money-fast' schemes or 'pyramid/chain' letters.
- Threatening bodily harm or property damage to individuals or groups.
- Making fraudulent offers of products, items, or services originating from your account.
4. In enforcing these policy provisions, subscribers hereby undertake to indemnify SKYBROADBAND for, and hold SKYBROADBAND free and harmless from, any and all liability, which it may incur arising there from or as a result thereof.
5. Subscribers are responsible for ensuring that their network is secure. Subscribers' action or inaction must not allow others to gain access to SKYBROADBAND and subsequently violate any of the provision in this AUP.
6. SKYBROADBAND shall cooperate fully with any officially recognized law enforcement body to the best of its capability when required to do so by force of law regardless of subscribers having or not having violated this AUP.
7. In the event that a subscriber’s Domain Name/s and/or assigned IP address/es be listed on shared public black list as a result of spam activities and or compromised computers, it is the responsibility of the subscriber and/or the domain owner to unlist said Domain Name/s and or assigned IP address/es from these entities.
8. The following are violations to this AUP:
- Unsuccessful or successful attempts at impersonation or forgery.
- Adding, removing, or modifying identifying network header information ("spoofing") in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited.
- Using re-mailers, nicknames, or misleading headers ("MUNGing" headers) in order to avoid spam email address collectors is allowed provided appropriate contact information is available in the body of any communication transmitted through SKYBROADBAND.
- Unsuccessful or successful attempts to gain access to any system or information.
- Unsuccessful or successful attempts to send or install a virus, Trojan, worm or other code that may violate other Internet users' privacy, destroy files, or install unsolicited programs regardless if the program is harmful or not.
- Threatening or harassing any person or organization using SKYBROADBAND. Using SKYBROADBAND service to perform illegal activities.
- Reselling the SKYBROADBAND service without explicit written consent.
- Reselling is defined as using the internet service for any purposes other than that of a residential use, including but not limited to internet café, web hosting services, etc.
- Activities that disrupt or degrade the service quality of SKYBROADBAND's network. Such activities are Denial of Service attacks against any individual or network host.
- Improper use of email services:
Using an email address in the skybroadband.com.ph domain to collect responses for unsolicited commercial email.
Sending excessively large volumes of email in terms of both size of email and number of emails regardless if the email is commercial or not.
Sending more than 10 essentially similar emails to the same email address ("mail bombing").
Maintaining an inactive mailbox. SKYBROADBAND reserves the right to delete contents of a mailbox and assign that email address for another purpose if the mailbox has not been accessed for more than 30 days.
Subscribing email addresses to mailing lists without the consent of the owner of that email address.
Activities that facilitate the above items.
- Improper use of Web / FTP Service: Using a URL in the skybroadband.com.ph domain to collect responses for unsolicited commercial email.
- Improper use of IRC or Chat Service:
- Posting essentially similar messages to the same chat room ("Flooding").
- Unsolicited commercial messages.
- Use of bots other than SKYBROADBAND's own.
- Stalking or harassing other chatters using a chat service.
- Using the service in any fashion for the transmission or dissemination of images containing child pornography or in a manner that is obscene, sexually explicit, cruel or racist in nature or which espouses, promotes or incites bigotry, hatred or racism.
1. The I.P. address used to commit the violation.
2. The date and time (including the time zone).
3. Evidence of the violation such as full header information in emails and syslog files.
Actions that SKYBROADBAND may take may consist of but not limited to any of the following:
1. Issue written warnings.
2. Suspend the customer's account.
3. Terminate the customer's account.
